ChompChat Inc ("us", "we", or "our") operates the ChompChat SMS food ordering service (the "Service"). This page informs you of our policies regarding the collection, use, and disclosure of personal information when you use our Service.

Information Collection and Use

When you use ChompChat to place an order, we collect your phone number to facilitate the ordering process. For successfully placed orders that involve a payment, we use a third-party payment service, such as Square, to process the payment, and then receive and store information related to your payment, which may include your name and address. We do not store credit card information. We do not collect any other personal information.

We use the personal information we collect solely for the purpose of processing your orders, facilitating payments, and providing necessary order details to the restaurants you have ordered from, as well as for improving our product.

Disclosure of Information

ChompChat maintains strict privacy policies to protect the personal information of our users obtained for text message communications. The information we collect is used only within our system to process your orders and communicate with the restaurants you have selected. This information is never sold, rented, released, or traded to others without prior consent or legal obligation. Any sharing of information with third parties is solely for the purpose of fulfilling the organization's obligations to the user. We guarantee that it will never be shared with third parties for marketing purposes.

SMS Communication

We do not initiate SMS conversations. Users begin SMS communication by sending messages to one of our active numbers to place orders with restaurants. Sending a message to one of our active numbers to begin placing an order is considered an opt-in to receive SMS communications relevant to that order. You may opt out of SMS communications at any time by replying with "STOP" to any message you receive from us. Once we receive your message, you will no longer receive further SMS communications from us.

Use and Disclosure of SMS Data: We use your SMS data solely to process your orders and communicate with you regarding your transactions. We do not share your SMS data with third parties for marketing purposes. Data shared with third parties, such as payment processors or restaurants, is strictly for completing your order.

Retention of Information

As a user of ChompChat, you have the ability to view and update the personal information we have collected from you. However, please note that opting out of data collection is not possible, as we require the minimal information we collect to successfully process your orders.

We will retain and use your personal information for the period necessary to comply with our legal obligations, resolve disputes, and enforce our Policy, as long as your user account remains active.

Privacy of Children

ChompChat is not intended for use by anyone under the age of 18. We do not knowingly collect personal information from children. If you are under the age of 18, do not use ChompChat or provide any personal information to us.

Information Security

We secure information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use, or disclosure. We maintain reasonable administrative, technical, and physical safeguards in an effort to protect against unauthorized access, use, modification, and disclosure of personal information in our control and custody. However, no data transmission over the Internet or wireless network can be fully guaranteed.

Third-Party Links

Our Service may contain links to other websites that are not operated by us. If you click on a third-party link, you will be directed to that third party's site. Note that these external sites are not operated by us. Therefore, we strongly advise you to review the Privacy Policy of these websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

Data Breach Notification

In the event of a data breach, we will notify affected individuals within a reasonable timeframe, per legal requirements. We will take all reasonable efforts to minimize harm and restore security to our systems.

Disclosures for Residents of California

If you are a resident of California, you have specific rights granted by the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). We aim to take reasonable steps to allow you to access, correct, amend, delete, or limit the use of your Personal Information. This section explains your rights under these acts and outlines how you can exercise them.

Your Rights Under CCPA and CPRA:

  • Right to Know and Access: You have the right to request the disclosure of certain information about our collection and use of your personal information over the past 12 months. Upon receiving and verifying your request, we will disclose to you:

  • Right to Correct: You have the right to request correction of inaccurate personal information held about you, considering the nature of the personal information and the purposes of the processing of the personal information.
  • Right to Non-Discrimination: You have the right not to receive discriminatory treatment for exercising any of your privacy rights conferred by the California Consumer Privacy Act.
  • Right to Opt-Out of Sale: You have the right to direct us not to sell your personal information at any time (the "right to opt-out"). We do not sell personal information, so this right does not apply to our operations.

How to Exercise Your Rights:

You may submit a verifiable consumer request to know or delete your personal information by contacting us at michaelholtonprice@chompchat.com. Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
